Sigorta şirketlerinde risk ve mali yeterlilik: Avrupa Birliği düzenlemesi Solvency II1

Abstract

Sigortacılık güvene dayanan bir sistemdir. Sigortacılık alanında yapılan düzenlemelerle poliçe sahiplerinin korunması amaçlanmaktadır. Sermaye, sigorta işinin sürdürülmesindeki anahtar unsurlardan biridir. Sigorta şirketlerine riskleri sigortalama olanağının sağlanması, poliçe sahiplerine sözleşme ile sahip oldukları korumanın sürdürülebilmesi ve yatırımcılara şirketlerin mali durumu hakkında bilgilendirici ipucu veren unsur sermayedir. Bu nedenle de yönetilmesi ve korunması sigorta kuruluşları tarafından temel önem arz etmektedir. Sigortalıları korumak amacı ile sigorta işlemlerini denetleyen otoriteler, sigorta kuruluşlarının faaliyetlerini kontrol etmek için çeşitli sistemler oluşturmuşlardır. Bu sistemlerin önemlilerinden biri mali yeterlilik düzenlemeleridir. Mali yeterlilik düzenlemeleri, ödeme gücü ile birlikte teknik karşılıklar, risk yönetimi, raporlama gibi çeşitli kontrol sistemlerini kapsamaktadır. Bu çalışma ile sigorta şirketlerinde mali yeterlilik konusu; mevcut durum, Avrupa Birliği düzenlemeleri açıklanmıştır. Türkiye’deki mali yeterlilik düzenlemeleri, Avrupa Birliği ile karşılaştırılması ve öneriler sunulmuştur.

Insurance is a system based on trust. The arrangements made in the field of insurance is to protect policy-holders. Capital is the continuation of the insurance business is one of the key elements. The possibility of insuring the risks of insurance companies, ensuring that they have contractual protection to policyholders and investors in the sustainability factor that tips informative about the financial situation of the companies capital. Therefore, it is of fundamental importance in the management and protection by insurance companies. Control authorities in order to protect the insured and insurance operations, in order to control the activities of insurance companies have created a variety of systems. This is one of the important systems of financial solvency regulations. Solvency regulations, together with the technical provisions solvency, risk management and control systems of a variety of reporting. In this study, the financial solvency of insurance companies, the current situation, explained the regulations of the European Union. Turkey’s financial solvency regulations, and recommendations presented in comparison with the European Union.
